Right of withdrawal

RIGHT OF WITHDRAWAL

You have the right to cancel an order without giving any reason. This right is the right of withdrawal established by art. 102 el Real Decreto Legislativo 1/2007, de 16 de noviembre, which approves the consolidated text of the Ley General para la Defensa de los Consumidores y Usuarios and other complementary laws.

To cancel an order you can use the attached form (withdrawal form) or you can notify us by e-mail to info@torrerosa.com or by post to the address La Torre Rosa 1987, S.L. / C/ Francesc Tàrrega, 22, 08027 Barcelona. If you send us an email or written communication, please include the details of your order to help us identify it.

Withdrawal period shall expire in 14 calendar days from the day on which you or a third party, other than the carrier, and indicated by you, acquired the material possession of the goods or, in the event that products making up the order are delivered separately, 14 calendar days from the day on which you or a third party, other than the carrier, and indicated by you, acquired the material possession of the last of the aforementioned products.

Once the right of withdrawal has been exercised, you must return products delivered to the address indicated La Torre Rosa 1987, S.L. / C/ Francesc Tàrrega, 22, 08027 Barcelona.), assuming costs of return. Please note that if you decide to return goods to us at postage due, we will be entitled to charge you for any costs we may incur.

The right to withdraw from contract shall apply only to those products that are returned in the same condition in which customer received them. No refund will be made if product has been used beyond the mere opening of it, products that are not in the same condition in which they were delivered or have suffered any damage, so you should be careful with product/s while they are in your possession. Please return item(s) using or including all original packaging with all tags. Please do not remove tags until you are sure you want to keep each item.

After examining the item, we will let you know if you are entitled to a refund. If return includes entire purchase, correct procedure has been followed and products are new and unused, we will proceed to refund total amount of purchase plus shipping costs within 14 days of receiving cancelled order.

If return only includes part of order, correct procedure has been followed and products are new and unused, we will only refund you returned products value, excluding shipping costs.

In the case of downloadable products (gift vouchers, etc), you can only cancel an order if it has not yet been shipped. This right will not be applicable, among others, to “m) The supply of digital content that is not provided on a material support when execution has begun and, if the contract imposes a payment obligation on the consumer or user, when the following conditions are met: 1st. The consumer or user has granted your prior consent to start the execution during the term of the right of withdrawal. 2nd. The consumer or user has expressed his knowledge that, consequently, he loses his right of withdrawal; and 3rd. The employer has provided a confirmation in accordance with article 98.7 or article 99.2.”, according to point m of Art. 103 of Real Decreto Legislativo 1/2007, de 16 de Noviembre.

In the case of downloading the product, the aforementioned exception to the right of withdrawal will apply at the same time the purchased content is downloaded.
